Terms and Conditions

These Terms of Service (“Terms”, “Terms of Service”, “Agreement”, or “Service Agreement”) govern your relationship with the Sunrise Times app (the “App”) and the creators, Craig Phillips Pty Ltd. (“us”, “we”, or “our”). It is important that you read this carefully because you will be legally bound to these terms.

Your access to and use of the App is based on your acceptance of and compliance with these Terms. These Terms apply to all users, customers, and others who access or use the App.

By accessing or using the App you agree to be bound by these Terms and accept all legal consequences. If you do not agree to the terms and conditions of this Agreement, in whole or in part, please do not use the App.

  1. Usage
    The App is for entertainment and informational purposes only. Some information provided in the app may be inaccurate and wrong. Craig Phillips Pty Ltd is not responsible for any of those errors.
    All the information provided in the App is provided without warranty of any kind.

  1. Subscriptions
    The App has an optional In-App Purchase titled ‘Sunrise Times Supporter’, which is billed on a recurring annual subscription basis (“Subscription”). The Subscription is offered for a 12 month period and billed at $0.99 USD (“Subscription Rate”) per year (“Subscription Period”). Prices will vary by country.
    The Subscription provides no additional features at this time, though it may unlock cosmetic rewards in the future.
    Payment will be charged to your iTunes Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current Subscription Period and will be billed at the Subscription Rate.
    Your Subscriptions may be managed and auto-renewal may be turned off by going to your Account Settings after purchase (you can follow the Manage Subscription button provided on the ‘About’ page (accessed via the Cog Icon in the Apps navigation bar) or navigate to the following section of the iOS Settings: iTunes & App Stores > Tap on Apple ID > View Apple ID > Subscriptions).

  2. Fee Changes
    Craig Phillips Pty Ltd, in its sole discretion and at any time, may modify the Subscription fee. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
    Craig Phillips Pty Ltd will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
    Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
    You will also receive notification of any changes from the iOS App Store following Apple’s normal procedures.

  3. Refunds
    Except when required by law, paid Subscription fees are non-refundable.

  4. Intellectual Property
    The App and all contents, including but not limited to text, images, graphics or code are the property of Craig Phillips Pty Ltd and are protected by copyright, trademarks, database and other intellectual property rights.
    You may display and copy, download or print portions of the content from the different areas of the App only for your own non-commercial use. Any other use is strictly prohibited and may violate copyright, trademark and other laws.
    These Terms do not grant you a license to use any trademark of Craig Phillips Pty Ltd or its affiliates.

  5. Links To Other Web Sites
    The App includes a link to the Sunrise-Sunset.org website a third party web site the services of which are not owned or controlled by Craig Phillips Pty Ltd.
    We have no control over, and assume no responsibility for the content, privacy policies, or practices of Sunrise-Sunset.org website or it’s services. We do not warrant the offerings of any of the entities, individuals or their website.
    You acknowledge and agree that Craig Phillips Pty Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party web sites or services.
    We recommend that you read the terms and conditions and privacy policies of any third party web sites or services that you visit.

  6. Termination
    You are entitled to cease using our App at any time and for any reason without notice to us, but Apple will continue to charge the Subscription rate on your renewal date until you cancel it as described in Section 2. Subscriptions

  7. Limitation of Liability
    In no event shall Craig Phillips Pty Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party used by the App; (iii) any content obtained from the App; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

  8. Disclaimer
    Craig Phillips Pty Ltd makes no guarantees, representations or warranties of any kind as regards the App or it’s dependent services and technology. Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law. Your use of the App is at your sole risk.

  9. Governing Law
    These Terms shall be governed by, and interpreted and enforced in accordance with, the laws in the State of New South Wales and the laws of Australia, as applicable.

    If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our App, and supersede and replace any prior agreements, oral or otherwise, regarding the App.

  10. Changes
    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is significant we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a significant change will be determined at our sole discretion.

    By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the App.
